My cousin is in jail in Mississippi State Penitentiary in Sunflower County. It is one of the non-violent offenses (false identity). It is being denied medical treatment. He has a skin disease called Lupus. From now on, his condition has become worse. He's running a fever over 100, sores in the mouth and his head is bleeding sores. He has written three letters of request to see a dermotostgist and has been denied. Do we have a case?
It depends on what kind of case you are concerned. They prison is required to treat a patient because of health problems. Especially with the severity of the disease (fever and pain bleeding), I doubt that is denied treatment. I would contact your state's Bureau of Prisons (or whoever Mississippi governing body for prisons would be) and express their concerns. If you are looking to file a civil lawsuit against the state, you really need to contact a lawyer in your state. They are the best to talk, and many will make a query with you at no cost / minimal, or, depending on the income of his cousin and financial resources, find an agency pro bono legal services. They assist Free Legal / minimal cost. If your cousin decides to file a lawsuit against the state, has to document everything (and I mean everything). Dates / Times / Correction names of the officers / requests / treatments / medications. In a civil lawsuit, much more of a burden placed on him then, if this were a criminal trial.
